4. The application did not include the certification for posting of the notice required under <br />Rule 1.6.2(1)(b). Please ensure that an appropriate notice is posted at the proposed site and <br />submit an appropriate certification to the Division in accordance with Rule 1.6.2(1)(b). <br />5. Pursuant to Rule 1.6.2(1)(a) and 6.4.17, please provide proof of notice of the application <br />provided to the Board of Supervisors of the soil conservation district (Exhibit Q). <br />6. Please provide the information required under Rule 6.4.7 in Exhibit G, Water Information. <br />7. Please provide the information required under Rule 6.4.8 in Exhibit H, Wildlife Information. <br />8. Please provide the information required under Rule 6.4.12 in Exhibit L, Reclamation Costs. <br />9. The application did not include a performance warranty. Please find enclosed a blank <br />performance warranty for your use. Copy of the warranty forms and the Construction Materials <br />Act and Rules are also available at the Division's web site at www.mining.state.co.us. <br />Pursuant to Rule 1.4.1(8), the Applicant has 60 days from the date of this notice, by September <br />11, 2009, to submit all the necessary documents the Division needs for the application to be <br />considered filed. If, by September 11, 2009, the application has not been determined to be filed <br />the Division may deny the application and terminate the application file. <br />Once the application has been filed with the Division the 90-day decision-making time period, <br />described under Rule 1.4.8, may commence.
