Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (Division) has received Colowyo Coal <br />Company, LP's (Colowyo) responses to the Division's 24 March 2009 preliminary adequacy <br />review, dated 12 June 2009. Thank you for your responses. The Division has reviewed the <br />responses and additional information provided and has the following comments and adequacy <br />questions. <br />Rule 2.05.3 - Operations Plan <br />Colowyo has added the map citations to the text on Page 2.05-9 as requested. Item <br />Resolved. <br />2. Colowyo has added clarifying text regarding the location(s) of more detailed road <br />information to Page 2.05-9 as requested. Item Resolved. <br />Rule 4.03.1(1) - Haul Roads-General Requirements <br />3. In the TR-76 response letter Colowyo states that reclamation of the South Taylor haul <br />Road will be "addressed as required by Rule 4.03.1(7) and will take place after <br />Colowyo has determined that the road will no longer be needed for operations, <br />reclamation or monitoring". The Division needs a more affirmative statement in the <br />text that the haul road will, in fact, be reclaimed and the area replaced to AOC and the <br />approximate timing and method (i.e. during the reclamation of the final pit area). <br />Additionally, it is the Division's understanding that the South Taylor Haul Road will <br />remain open until final closure of the South Taylor Pit has been completed (around <br />2021). The backfilling of the haul road corridor, however, is not shown on either of <br />the spoil grading maps (Maps 29 and 29A). Please include additional detail to the <br />permit text regarding the reclamation of the South Taylor Haul Road and please <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
