Bestway will furnish Smart Reservoir a Certificate of Insurance naming Smart Reservoir as
Additional insured, .and agrees to pay worker's cramp.
Water Uses:
Concrete Batch Plant
Aggregate Wash Plant
Roads:
Bestway agrees to maintain the haul road and add gravel and road base as needed.
Bestway will water haul road as needed to control dust. Dust control water will be
lagged and paid for unless otherwise agreed.
Dust Control:
Bestway agrees to control dust at the Hwy 93 pit site at the Batch Plant site and
rather haul roads including Smart Reservoir haul road.
On Site re-vegetations re-seeding and reclamation:
As needed by Bestway
Water Exclusive use byBestway HAI 93 Use:
No offsite users will be permitted unless it is Smart Reservoir and Church Ranch
Companies unless approved in writing by Smart Reservoir.
Temporary Event:
Bestway agrees to load and haul raw water for Smart Reservoir or Church Ranch
Companies, such as Cattle operation, in the rare event ofa necessity arising. Smart
Reservoir or The Church Ranch Companies will promptly pay the Bestw ,y invoice for;the
water trucking costs at the rate of $55.00 per hour.
