Regarding the lien, I notice the letter is from the Dept. of Revenue. I have never seen any correspondence
like this, and to the best of my knowledge DRMS does not deal with taxation issues. So I really cannot
provide any guidance on the matter. I am copying Tony Waldron on this correspondence, who may have
some experience in such matters and may be able to provide advice.
I am available if you have additional questions.
Regards,
David Bird
Division of Reclamation, Mining & Safety
Department of Natural Resources
1313 Sherman Street, Rm 215
Denver, CO 80203
Tel: 303-866-3567 x8108
Fax: 303-832-8106
email: david.bird@state.co.us
http: //mining. state.co.us/
From: John Browning fmailtoJb@poplar.com]
Sent: Thursday, June 25, 2009 10:34 AM
To: Bird, David
Subject: Fwd: more Penn Mountain
Dear David,
This is to follow up my phone message. As I said, the deal to sell Penn Mt seems to be going ahead, but slowly.
Rather than stretch your patience with another request for extension on the new environmental bond, I am
willing to file the increased amount -- though if you are feeling generous on extensions that would of course be
appreciated.
My first question is how do we do this? I'm assuming we can simply increase the existing letter of credit
arrangement. I will contact my bank to see what needs to be done at their end, but who do I need to talk to at the
Colorado state end?
Second, attached please find a rather ominous note from the state about a lien regarding unsettled amounts for
Metallic Minerals Severance. I must admit I had received correspondence about this before, but had assumed
that it had to do with the bond and therefore filed it. I now wonder if it is in fact to do with the bond, but, if not,
what it's about. More important, I wonder how I can stop the lien and sort this out. I very much hope that we
don't actually owe the money and that there has been some confusion which we can now clear up. It is a lot of
money.
I look forward to hearing from you.
with best regards,
John
