Keci <br />M amatioMining and Safety ' <br />RE: Foidel Creek Mine (Permit No. C-82-056), Response to Comments on 2008 AHR <br />Dear Mr. Kaldenbach: <br />We are in receipt of your letter dated June 12, 2009 with comments on the 2008 Annual Hydrology Report, and <br />offer the following responses: <br />• Page 11, 5`h paragraph. Corrected. <br />• Water Quality Period of Record Summary. The pages are actually from 2007. Our old hydro data <br />system is gone. Peabody Energy is in the process of implementing a new hydro database system <br />company wide. I was originally informed the database system would be available last year, however <br />continued delays make it look more like this fall. Once available, TCC will update the database and re- <br />submit the Summary data tables. I have made Janet Binns aware of this situation. <br />• Table 46 - July 2008 water quality data has been added. <br />• Table 48 - There is no recorded flow data for site 1005 March through June 2008. On the last day in <br />March 2008 I discovered severe damage to the 1005 gage station and subsequently asked one of our <br />contractors to replace it. Unfortunately, the site is in a distant location and difficult to get to during <br />snow/wet conditions, so the contractor did not get around to replacing it in April. I repaired the station <br />structure in May, however needed to come back with some measuring cable attachments. Upon <br />returning a few days later, I discovered it had been damaged again. In 2007, TCC hired a consulting <br />firm (River's Unlimited) to assist with gaging surface streams and re-evaluating our rating curves. I was <br />under the impression that they would start estimating high stream flows in May 2008. I found out later <br />that they started gaging sites in early June, but did not start estimating flows for site 1005 until July 1, <br />2008. A spread sheet of their data is attached. They later assisted with multiple gage station repairs. I <br />apologize for not including a more detailed explanation of this situation on page 10 under the Steam <br />Gaging section. <br />Please feel free to contact me with any questions. <br />Best regards, <br />Brian A.
