BOWIE RESOURCES, LLC <br />Bowie No. 1 Mine <br />Coal Mine Waste Bank Inspection - 2nd Quarter 2009 <br />On June 9, 2009, 1 performed the quarterly inspection of the Bowie No. 'I Mine coal <br />mine waste bank in accordance with Rule 4.10.2(2)(a). This rule states that inspections <br />may terminate when the coal mine waste bank has been graded, covered in <br />accordance with 4.10.4(4), topsoil has been distributed on the waste bank in <br />accordance with 4.06.4, and revegetated. <br />I, J. E. Stover, P.E., have a wide variety of experience in the design and construction of <br />earth fill embankments. Nothing was observed during the inspection that would indicate <br />the pile has a potential for failure. The gob disposal area was dry. The pile has been <br />covered-with 4:O-feet-of`non=toxic--cover;-se-eded an-d-mulched.- The-upper iversion-- -- -- <br />ditch was inspected with no problems noted. <br />The design of the waste disposal area is presented in Volume 6A. The design of the <br />upper diversion ditch is located in Volume 8 under the drainage ditches slab. The upper <br />diversion ditch is shown on Map 8-1A as section E-E. Page D-1 and D-26 indicate the <br />upper diversion ditch section E-E is to be a 0.83 foot deep v-ditch. The upper diversion <br />ditch shown on drawing 6A-5D shows the upper diversion ditch is to be a 1.0 foot deep <br />v-ditch. The upper diversion ditch is to be constructed at least 1.0 foot deep as shown <br />on drawing 6A-5D. <br />To the best of my knowledge and belief, based on my inspection of the pile and <br />previous inspections by professional engineers, the coal mine waste bank has been <br />constructed in accordance with the approved plan. <br />The pile is located in a remote area well away from human habitation. A failure of the <br />pile might damage the mine haul road located below the pile. However, a failure of the <br />pile would probably not be a hazard to human life. <br />Recommend maintenance: None g3 Rg'?7poo? <br />oo?Pooooooo?aa <br />q\®o °c?
