CO <br />Robins Construction. <br />Three members of the public spoke in opposition at public hearings and seventeen spoke <br />in support. <br />PART H - PLANNING COMMISSION REVIEW AND RECOMMENDATION <br />WHEREAS, pursuant to Article 3.2(C) of the CCLUC, a public hearing was held before the <br />Conejos County Planning Commission on February 25, 2004, upon proper notice to adjoining <br />land owners and publication in a legal newspaper, The Conejos County Courier, a publication <br />of general circulation in the County of Conejos. <br />At the conclusion of that hearing, the Planning Commission recommended approval of said <br />application with the condition that if the County Commissioners impose a time limit on the <br />application there is a stipulation that they do have the right to reapply in the future. There <br />were three votes in favor, one opposed, and one abstention. <br />PART III - BOARD OF COUNTY COMMISSIONERS HEARING <br />WHEREAS, pursuant to Article 3.2(D) of the CCLUC, all surrounding land owners have <br />been given proper notice of the public hearing held on April 15, 2004, and duly conducted by <br />the Board of County Commissioners of Conejos County, at which hearing interested persons <br />were given an opportunity to be heard; and, <br />WHEREAS, the subject real property, although zoned Rural (RU), is adjacent to 2 <br />subdivisions: Conejos Valley and Conejos River Trails. Conejos Valley consists of 17 lots, 10 <br />of which are developed. Conejos River Trails consists of 48 lots, 6 of which are developed. <br />Additionally, to the south of the subject real property, there exists a strip of land zoned <br />Industrial; and, <br />WHEREAS, at the public hearing on April 15, 2004, the Board and Applicant agreed that <br />the public hearing would be continued to May 6, 2004 to receive certain additional <br />information; and, <br />WHEREAS, the written decision of this Board is due within 30 days of said hearing, being <br />June 5, 2004; and, <br />WHEREAS, the members of the Board of County Commissioners considered the application <br />and have concluded that the Conditional Use Review Application should be approved. The <br />Board of County Commissioners concluded that this application was significantly different <br />from the previously denied application, which was deemed incompatible with surrounding <br />2
