'' / <br />RE: Wellington Downs Pit, File No. M-1995-035 <br />Operator: Connell Resources, Inc. <br />Contact: Richard Connell, (970) 223-3151 <br />Section 3, Twp 6N, Rng 68W, 6th P.M., Larimer County <br />COMMENTS: On June 30, 2009, Connell Resources, Inc. requested full reclamation responsibility release <br />for the Wellington Downs Pit, permit no. M-1995-035. The Wellington Downs Pit liner was approved by <br />the Division 1 office in a letter dated July 5, 2007 pursuant to the State Engineer's Guidelines for Lining <br />Criteria. A substitute water supply plan approved for the pit on October 25, 2006 approved the replacement <br />of 95% of lagged depletions from recharge credit from the operator's recharge site. According to a letter <br />from the applicant's consultant dated January 12, 2009, Connell has continued to replace the remaining 5% <br />lagged depletions. Excess augmentation credit from diversions into the Connell's recharge pond from the <br />2008 irrigation season were sufficient to replace monthly depletions through March 31, 2009, at which point <br />lagged depletions are considered to be 100% replaced.
