Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on March 7, 2008, an application to renew an existing permit to conduct <br />coal mining operations at the Eagle Mine Complex was considered complete for the purposes of filing. All review and <br />comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. <br />BTU Empire Corporation proposes to continue Underground coal mining and/or reclamation operations on land. located <br />approximately 7 miles Southwest of Craig, Colorado. The permit area is further described as follows: <br />All or portions of Sections 4, 5, 6 and 8, T5N, R91 W; part of Section 1, T5N, R92W; and Sections 17, 19, 20, 21, 28, 29, 30, <br />31, 32 and 33, T6N, R91 W; portions of Sections 25, 26, 35 and 36, T6n, R92W; 6th Prime Meridian. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Round Bottom and Castor Gulch. <br />The BTU Empire Corporation has submitted a complete application for a Permit Renewal (RN-05) for the Eagle 5 & 9 Mines <br />south of Craig Colorado. The Eagle Mines are an underground mining operation and are currently in temporary cessation, with <br />no active mining being performed at the mine. The Eagle Mines are conducting environmental monitoring as required by the <br />permit and maintenance activities as required. This renewal application does not include any proposed changes to the permit <br />and no additional lands are being proposed for inclusion into the permit boundary or disturbed boundary. Pursuant to Rule <br />2.08.5, the BTU Empire Corporation has retained the right of successive renewal for the Eagle 5 & 9 Mines. The Division <br />currently holds a performance bond for the Eagle Mines in the form of a corporate surety in the amount $3,552,679.00. The <br />Division will recalculate the reclamation liability for the Eagle Mines to ensure that this amount is sufficient. <br />A copy of the renewal application is available for public inspection at the Moffat County Clerk and Recorder, 221 West Victory <br />Way, Craig, CO 81625, and at the Division office.
