Box 186 Natural Resource Trustee <br />Kremmling, Colorado 80459 <br /> <br />RE: Bum ardner Ranches Inc.• File No. <br />g M-1980-027 " <br />Bumgardner Ranches Gravel Pit; Financial Warranty Increase (SI-02) -Revised <br />Dear Mr. Bumgardner, <br />On April 14, 2009, the Division of Reclamation, Mining and Safety (Division) conducted an <br />inspection of the Bumgardner Ranches Gravel Pit, File No. M-1980-027. <br />According to Rule 4.2.1(1) and (2), the Division may review a financial warranty at any time to <br />determine if the amount is sufficient to perform reclamation. The Division currently holds a <br />financial warranty of $20,976. Based on the inspection, the financial warranty is not sufficient <br />to perform the approved reclamation at the site. The Division prepared a reclamation cost <br />estimate for the Bumgardner Ranches Gravel Pit based on the inspection and the commitment <br />by DM1 General Contractors to limit the maximum disturbed acreage to nine (9) acres <br />submitted as part of Technical Revision No. 2. The Division estimates the cost to reclaim the <br />site is $25,000. This is an increase of $4,024 from the current financial warranty. <br />This letter is to inform you that your financial warranty will need to be revised within 60 days <br />from the date of this letter. A copy of calculations used to determine this cost is attached for <br />your review. <br />If you wish to submit a different type of Financial Warranty, the various application forms can <br />be found at the following website: http://minin~.state.co.us/Mineral%20Forms.htm. An <br />additional $500 is required if Bumgardner Ranches, Inc. elects to submit the financial warranty <br />as an Irrevocable Letter of Credit for a total increase of $4,524.
