[Rule 3.03.2(5)]. The Proposed Decision is made available to the public and interested agencies for <br /> 30 days. If uncontested, the proposed decision becomes final [Rules 3.03.2(3) and(5)(b)]. If the <br /> proposed decision is to grant the bond release, bond release actions are processed. If contested, a due <br /> process is engaged to determine the fate of the application. <br /> This bond release action was initiated by NCIG Financial, Inc. by submission of an application [Coal <br /> Ridge No. 1 Mine Request for Partial Bond Release Permit No. C-84-065 of March 27, 2001 <br /> (Application)]. The Application was received at the Division on March 29, 2001. The Application <br /> was found complete on May 22, 2001. The Applicant had provided proof of publication of a public <br /> notice regarding the application in the Glenwood Springs Post Independent on April 18 and 25, and <br /> May 2 and 9, 2001. The Applicant had also notified landowners within and adjacent to the mine <br /> permit area and other interested parties of the application for bond release [Rule 3.03.2(1)]. The <br /> Division received no comments, written objections, or requests for an informal conference in <br /> response to the public notice. <br /> The Division conducted an on-site inspection (Inspection) of the reclaimed site on June 20, 2001 <br /> [Rule 3.03.2(2)]. Persons attending the inspection were James E. Stover, representing the Applicant, <br /> and Daniel I. Hernandez, Janet H. Binns, and Byron G.Walker of the Division.Although landowners <br /> had been notified, none attended the inspection. <br /> II. Criteria And Schedule For Bond Release <br /> Schedule <br /> Bond releases are processed in three phases.A Phase I bond release applies to areas where backfilling, <br /> regrading and drainage control have been accomplished [Rule 3.03.1(2)(a)]. Verification of topsoil <br /> replacement may occur at Phase I or at Phase H. This Application includes a request for release of <br /> residual Phase I bond requirements at the site.A Phase II Bond release includes establishment of <br /> vegetation which supports the approved postmining land use, a determination of whether the <br /> vegetation cover meets an approved standard, and a determination of whether the level of suspended <br /> solids being contributed to streamflow or runoff outside the permit area is less than or equal to either <br /> premining levels or levels on adjacent non-mined areas [Rule 3.03.1(2)(b)]. This Application includes <br /> a request for release of Phase II bond requirements. This Application does not include a request for <br /> release of bond for sediment control facilities [Rule 3.03.1(5)].A Phase III bond release is appropriate <br /> when the permittee has successfully completed all surface coal mining reclamation operations in <br /> accordance with the approved reclamation plan, and the final inspection and procedures of Rule <br /> 3.03.2 have been satisfied.
