of drainage structures.Tasks include demolition,backfill, topsoil and revegetation of the <br /> sedimentation pond (including associated culverts, head box, discharge structure and ditches); grading <br /> and revegetation of small area exemption drainage structures, and revegetation of the footprints of <br /> topsoil storage piles (topsoil being used in the sedimentation pond reclamation). <br /> Degree of Difficulty to Complete any Remaining Reclamation <br /> The Division finds that there is no undue degree of difficulty in the accomplishment of the remaining <br /> reclamation at the site (see tasks above) <br /> Occurrence of Surface or Groundwater Pollution <br /> No record was found of any discharge or runoff from the site in Division monthly inspection reports <br /> (1992 to present), Colorado Department of Public Health and Environment Discharge Monitoring <br /> Reports (1989 to present), and Annual Hydrologic Reports (1989 to present). The suspension of <br /> original requirements for subsurface water monitoring had been approved due to premature <br /> suspension of mining activities and no observed adverse impacts (PAP). There was no occurrence of <br /> discharge or flows from the site during the Phase H Bond Release inspection conducted by the <br /> Division. There was no evidence of surface erosion(no erosional features) at the time of the Phase II <br /> Bond Release Inspection by the Division. <br /> Potential for Surface or Groundwater Pollution <br /> Based on the degree of disturbance at the time of cessation of mining activities, and the observations <br /> outlined in this Proposed Decision and Findings Documents, the Division believes that the potential <br /> for surface or groundwater pollution is low. <br /> Minimum Bond <br /> The Division proposes a minimum bond requirement of$43,200 under this SL-02 bond release <br /> application, more than the$10,000 minimum bond amount required by Rule 3.03.1(4). <br /> Summary and Conclusions <br /> Based upon a review of the mine PAP, the applicant's bond release Application as amended, and site <br /> inspections, the Division finds that NCIG, Inc. has successfully completed the surface coal mining <br /> reclamation operations in accordance with the approved reclamation plan and met all requirements of <br /> the Act and the Rules for the requested partial Phase I and complete Phase II Bond Release.Written <br /> results of the inspection were placed on file for public inspection at the offices of the Division in <br /> compliance with Rule 3.03.2(2).
