Please locate the area to be developed for commercial/industrial and residential uses on <br />the Reclamation Plan Map. <br />When changes warrant, the site will be updated to reflect the anticipated increase in mixed uses <br />via Technical Revision to the permit. For purposes of determining financial warranty, all lands <br />remaining above the anticipated static water level of the reservoirs, and not otherwise occupied <br />by allowed uses or structures, will be revegetated consistent with area agricultural uses and soils. <br />25. The Applicant states in Exhibit G that the pits will be lined upon the completion of <br />mining. There is no mention of lining the pits anywhere else in the permit application. Please <br />clarify if the pits will be lined or unlined. If they are to be lined, please provide the Division <br />with details on how and when the pit will be lined. Also, describe how the drawdown of the pits <br />and any associated shadow and mounding effect will impact surrounding well users and/or any <br />activities that rely on groundwater in the vicinity of the site. <br />All pits are to be extracted and reclaimed in an unlined state under the present submittal. The <br />applicant has sufficient waters to augment the entire potential acreage of exposed groundwater at <br />the surface to account for this consideration. The need to create lined reservoirs to liberate <br />augmentation waters is a cost benefit in relation to time consideration. <br />We anticipate at some point either after or immediately prior to reclamation release that the <br />reservoirs may be lined to accomplish this consideration. If it were to occur prior to release, a <br />technical revision to the permit will be applied for and warranty adjusted at that time. <br />Whether before or following release, should lining the reservoirs prove desirable, all planned <br />activities will comply with necessary federal, state and local law, including any necessary <br />permitting and approval with the Colorado State Engineer's Office of the Division of Water <br />Resources prior to the on-set of those activities. Until then, the plan under consideration in this <br />application provides for unlined reservoirs. <br />A groundwater study as reported by CGRS, details impacts to groundwater from planned <br />discharge during extraction activities. Any impacts to area wells will not occur on day one, but <br />over time. Varra Companies, Inc. will redrill any well who's water column is not deep enough to <br />withstand the potential impacts, prior to the anticipated impact on a particular well. As of this <br />writing, the nearby Haley well will be deepened to bedrock by Varra Companies, Inc. prior to <br />impact. It is the only well identified where there would be insufficient column depth subsequent <br />to drawdown from nearby discharge activities within the planned areas of extraction (essentially, <br />Tract A). <br />26. The Reclamation Plan does not indicate where the inlet and outlet facilities will be <br />located. Please provide the Division with the general location of these structures and identify <br />them on the Reclamation Plan Map. Also, provide the Division with design specifications of any <br />Varra Companies, Inc. correspondence of 30 June 2009 to the Colorado Office of Mined Land Reclamation 13 <br />(Office) in reply to Office correspondence of 12 May 2009 - Heintzelman Project - M2009-018.
