III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of <br /> Mountain Coal Company represented the operator. Photographs taken during the inspection are <br /> attached to the end of this report. With the operator's consent, this report was issued from the Denver <br /> office of DRMS. <br /> The ground was dry. The operator's representative explained that the longwall was active near the <br /> middle of E-Seam Panel 1. <br /> Hydrologic Balance <br /> Mine water was not discharging from outfall 017. <br /> Processing Waste <br /> The face of the Refuse Pile Expansion(RPE)pile appeared stable as viewed from the bottom of the <br /> slope. The slope has a good cover of grass and survey markers were in place. The operator is <br /> backhauling its refuse from the Bowie No. 2 Mine wash plant to the RPE where it is being <br /> incorporated into lifts on top of the pile. <br /> Support Facilities <br /> Panel E-1 methane drainage well sites appeared in good shape with alternative sediment control <br /> measures in place and no excessive erosion apparent. Most well pads inspected cover less than one <br /> acre. No weed problems were found. <br /> Topsoil <br /> Topsoil was stockpiled at each methane drainage well pad inspected over panel E-1. The stockpiles <br /> were not eroded and they had topsoil markers in place. <br /> General Mine Plan Compliance <br /> The operator appeared to be following the approved mine plan. Work recently approved in TR-116 <br /> has not yet begun at the Sylvester Gulch mine water treatment facilities. <br /> Subsidence <br /> No signs of subsidence were found along the road over the east end of panel E-1 which has been <br /> undermined in the last year. <br /> 3 <br />
