Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with. Title 34, Article 33, <br />Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 12, 2009, an application to revise coal <br />mining operations at the Yoast Mine was considered complete for the purposes of filinl;. The revision was <br />submitted by Seneca Coal Company, LLC. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This revision application would allow for termination of the wildlife monitoring program at theYoast Mine, based <br />on the fact that active mining operations have ceased and future activity will be limited to maintenance and <br />reclamation projects. <br />The surface coal mining operation is on land located approximately 7 miles Southwest of Hayden, Colorado. The <br />permit area is further described as follows: <br />T6N, R87W, Portions of Sections 28, 29 and 32 <br />T5N, R87W, All of Section 17; Portions of Sections 5, 8, 16, 18, 19, 20, 29, 30 <br />Mt. Harris & Dunckley <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Mount Harris and <br />Dunckley. <br />Because the above referenced technical revision application would alter a previously approved wildlife monitoring <br />program, we are requesting your agency's evaluation of the proposal. Your comments regarding the adequacy of <br />the amended plan, and whether you believe continued monitoring is warranted, are requested. <br />A copy of the technical revision is enclosed. Please advise us if you require additional information. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. <br />At the time of publication of this notice, the applicant is additionally required to place a copy of this application at <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
