Cattany <br />Division Director <br />Natural Resource Trustee <br />We have received your application for a technical revision to your permit to conduct coal mining in Colorado. Our initial <br />review indicates that all preliminary items required by Rule 2.08.4 have not been submitted. Thus, your application is <br />incomplete for the purposes of filing as of June 24, 2009. <br />We have identified the following deficiencies: <br />The proposed newspaper advertisement submitted with the application appears to describe the legal description, <br />acreage, and list of landowners for only the portion of the current Seneca II permit area. that would be retained <br />following approval of the revision. The proposed notice will need to be revised to include the legal description, <br />acreage, and landowner information for the current permit area, along with adequate explanation to clarify the legal <br />description, acreage, and landowners for the portion of the permit that would be retained. In addition, the proposed <br />notice should include a brief explanation of the proposal, including the circumstances driving the proposal and the fact <br />that over 3000 acres would be removed from the permit area. <br />2. There is a discrepancy between cover letter narrative and Map 13-2A, which needs to be corrected. The cover letter <br />indicates that the revised Seneca II permit area would consist entirely of the isolated Pond 004 watershed.
