Cattany <br />Ron Velarde Division Director <br />NW Regional Wildlife Manager Natural Resource Trustee <br />Colorado Division of Wildlife <br />NW Regional Service Center <br />711 Independent Ave. <br />Grand Junction, CO 81505 <br />Re: Seneca II Mine (Permit No. C-1980-005) <br />Technical Revision Application No. 49 (TR-49) <br />Wildlife Monitoring Termination <br />Dear Mr. Velarde: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance wi1:h Title 34, Article 33, <br />Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 24, 2009, an application to revise coal <br />mining operations at the Seneca II Mine was considered complete for the purposes of filing. The revision was <br />submitted by Seneca Coal Company, LLC. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This revision would allow for termination of the approved wildlife monitoring program at the Seneca H Mine, <br />which has been largely reclaimed. Justification to support the proposed termination of monitoring is included in <br />the application. <br />The surface coal mining operation is on land located approximately 9 miles Southeast of Hayden, Colorado. The <br />permit area is further described as follows: <br />T5N, R87W; All of Sections 1, 2 and 12; Portions of Sections 3, 11 and 13 <br />T6N, R87W; Portions of Sections 27, 34, 35 and 36 <br />T5N, R86W; Portions of Sections 6 and 7. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Milner and Mount Harris. <br />Because the above referenced technical revision application would alter a previously approved wildlife monitoring <br />program, we are requesting your agency's evaluation of the proposal. Your comments related to the adequacy of <br />the amended plan, and whether you believe continued monitoring is warranted, are requested. A copy of the <br />technical revision application is enclosed. Please advise us if you require additional information. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. <br />At the time of publication of this notice, the applicant is additionally required to place a copy of this application at <br />the Hayden Public Library, 201 E. Jefferson Avenue, Hayden, CO 81639-1813, and at the Division office.
