Mountain Ranch, the landowner, necessitated flexibility in regard to the reclamation seed mix <br />used. <br />PUBLIC COMMENT <br />Mr. Mitzelfeld thought that the light fixtures should be screened to restrict the lightbulb <br />glare visibility from the road and requested that a condition to that effect cover both the <br />construction and the operation periods of the project. He said that all of the structures and the <br />tanks should be painted the same neutral earthtone shade of green or brown, rather than <br />white. He stated that the installation of a silencer on the existing fan had significantly mitigated <br />noise levels so requested that a silencer be installed on the drilling rig as well as the fans since <br />five months of loud noise during the summer would be unpleasant. <br />At this time, Commissioner Monger exited the meeting due to illness and was absent for <br />the remainder of the day's proceedings. Chair pro tem Stahoviak conducted the remainder of <br />the day's hearings. <br />Commissioner Stahoviak called for further public comment; none was forthcoming. <br />Commissioner Stahoviak closed public comment. <br />ROUNDTABLE DISCUSSION <br />The Board reviewed the conditions of approval and the petitioner's suggested changes <br />for those conditions. Commissioner Stahoviak listed the conditions of the current permit, SUP <br />#PP2005-026, that were not included in the amendment and stated that those conditions <br />should be included in the amendment petition at hand. Changes and additions made to the <br />conditions of approval are incorporated in the motion below. <br />MOTION <br />Commissioner Mitsch Bush moved to approve the Twentymile Coal Company petition to <br />amend Special Use Permit PP2005-026 to allow two new ventilation shafts, one intake and <br />one return, and an access road under Section 4.9 of the Routt County Z---oning Regulations at <br />the Foidel Creek Mine in Oak Creek, with the findings of fact that, with conditions, the proposal <br />meets the guidelines of the Routt County Master Plan and is in compliance with Sections 4, 5, <br />7, 9, and 11 of the Routt County Zoning Regulations. <br />This approval is subject to the following conditions: <br />General Conditions: <br />1. The Special Use Permit (SUP) is valid until August 24, 2014. The SUP shall be <br />deemed to have automatically lapsed if the uses permitted herein are discontinued for a <br />period of one (1) year. <br />2. The SUP is contingent upon compliance with the applicable provisions of the <br />Routt County Zoning Regulations including but not limited to Sections 5, 6, 8 and 9. <br />Page 2009-288 <br />May 26, 2009 <br />Routt County Board of County Commissioners' Minutes
