b. A fence shall be erected around the perimeter of the site to fence livestock <br />out. A cattle guard and gate are also recommended to prevent livestock from <br />entering County Road 27. <br />C. All County roads used for the project will be maintained by the contractor <br />and/or permitted to accommodate the additional truck traffic during construction, <br />as required by the Routt County Director. <br />d. An access permit shall be obtained from the Routt County Department. <br />16. The permitee shall apply for and receive a Mined Land Reclamation Bond permit <br />and post a reclamation bond with the MLRB prior to commencing any operations. The <br />permitee shall be responsible for reclamation as set forth by the Colorado Mined Land <br />Reclamation guidelines. The permittee will provide Routt County Planning Department <br />with a copy of the State of Colorado, Division of Reclamation, Mining, and Safety <br />(CDRMS) bond prior to issuance of the Special Use Permit. <br />17. All road and bridge repair and maintenance agreements made with Routt County <br />prior to permit issuance shall be adhered to, and the permittee :shall follow the terms <br />and conditions set forth in the Road Monitoring and Maintenance Plan. <br />18. All electrical line poles shall be located outside of any County Road right-of-way <br />unless permission is obtained from the Routt County Road and Bridge Director. <br />19. All facilities associated with the Twentymile Coal Company (TCC) power bore <br />hole and the ventilation fan including power lines, roads, poles, and buildings shall be <br />removed, and any disturbed areas revegetated prior to closure of the mine, unless <br />approved in conjunction with a post-mine land use. <br />20. The permittee shall employ the most up-to-date technologies and equipment <br />available for noise abatement for all ventilation fan installations on the site. <br />21. The permittee shall hire, at the permittee's own expense, a third party acoustical <br />engineer to collect data to include, but not be limited to, decibel readings from the <br />ventilation fan at the 18-Left location. These readings shall comply with the standards <br />set forth by Colorado Revised Statute 25-12-103, or corrective action will be required. <br />22. The reclamation shall use a seed mix approved by the State or the landowner <br />and shall exclude any non-native aggressive grasses, forbs, and shrubs. <br />23. The permittee shall submit a landscape plan to the Planning Director for approval <br />prior to fan operation. <br />24. The permittee will install and maintain adequate measures -to exclude all types of <br />wildlife from all fluid pits. <br />25. The exterior buildings' and associated structures' materials shall be of colors <br />compatible with the existing character of the site. <br />26. All haul roads and disturbed sites shall be watered or chemically stabilized to <br />minimize dust. Watering operation shall be increased immediately in response to <br />periods of high wind. <br />27. The SUP is contingent upon the petitioner complying with the applicable <br />requirements of Regulation III.D of the Colorado Air Quality Control Commission, as a <br />minimum standard, with the following stipulations: <br />a. The operator shall establish a State approved fugitive dust plan for the <br />operation. Periodic inspections by the County could then be used to determine <br />compliance with the plan.
