Accordingly DRMS will be issuing Notices indicating there is reason to believe violations exist and <br />scheduling a hearing before the Colorado Mined Land Reclamation Board (Board) for August 12-13, 2009 <br />for failing to minimize disturbance to the prevailing hydrologic balance and failure to control erosion and <br />siltation, also for failure to protect areas outside of the affected land from damage. A formal notice of the <br />possible violations and notice of formal public hearing before the Board will be mailed separately from this <br />correspondence. <br />On June 5, 2009 the Mclntyres submitted a letter to DRMS outlining demands for repairs to the structures <br />by certain days and penalties for non-achievement.
