The first is the obvious damage to the bridges which based on <br />observations was created by material being deposited down gradient due to snow removal activities by Colorado <br />Stone during the winter. The second issue is a sedimentation control issue which is allowing materials to be <br />deposited into Yule Creek. As noted a review of the situation including the facts from this visit and the approved <br />permit will be undertaken prior to any decisions as to the course of action by DRMS. <br />An unrelated issue to the McIntyre complaint is the use of the staging area in the town of Marble itself. Colorado <br />Stone noted to both inspectors that the site is now being used to stockpile cut blocks of marble. This is a change in <br />the use of the area from a historical staging area for sold product to an offsite stockpile area. Per the Act CRS 34- <br />32.5-103 (1) and Rulel.1 (3) "Affect Land" includes storage areas. Therefore, when Colorado Stone began storing <br />or stockpiling marble at the lower site it should have submitted an amendment to the permit to include it in its <br />permit area.
