Cattany <br />Division Director <br />Natural Resource Trustee <br />Thank you for taking the time to meet with me on site to address issues noted in the September 2008 <br />inspection of the Martin Pit. As noted all issues are considered abated but there are two issues that <br />need to be addressed more thoroughly to assure no problems in the future. Both issues can be <br />submitted as one Technical Revision (TR) with the required fee of $216.00. <br />First you expressed a desire to have on file an affidavit for the importation of inert materials. Please <br />submit an affidavit that states: Per Rule 3.1.5(9), Duran and Pearce intends to on occasion backfill inert <br />structural fill generated outside the approved permit area. The materials will be earth, stone or <br />concrete free of any hazardous or toxic materials, trash, rebar or other steels. <br />The second issue is an approved plan for the control of noxious weeds on site. You have noted that you <br />have a meeting set up with the CSU Extension Officer already. Once you receive his recommendations <br />you can submit them with your plan for a formal control plan in the TR. I am requesting that Duran and <br />Pearce submit the TR by September 1St, 2009. <br />Another issue was possible exposure of groundwater. You noted the local DWR office had no issue with <br />the waters exposed on site.
