Cattany, Director Z'?ti009 <br />Division of Reclamation, Mining and Safety JAN `Gc\amaIN <br />Sa <br />I' 313 Sherman Street, Room 215 d der! <br />Denver, CO 80202 0 M???n9 V4 <br />RE: Bond Release Application No. 2 (SL-2), Termination of Jurisdiction, Grassy Gap <br />Mine, Permit No.C-1981-039, Proposed Decision and Findings of Compliance <br />Dear Mr. Cattany: <br />This letter acknowledges the Office of Surface Mining (OSM), Western Region (WR), Denver <br />Field Division's (DFD) receipt and review of the above Proposed Decision and Findings of <br />Compliance document prepared by the Division of Reclamation, Mining and Safety (DRMS) <br />dated June 5, 2009. DFD agrees with the findings and decision document and hereby provides <br />OSM concurrence for the above Termination of Jurisdiction (TOJ) action in accordance with 30 <br />CFR 700.11(d)(1), and 30 CFR 906.30, Article IX, Section 24 and 25, of the Colorado State- <br />Federal Cooperative Agreement. <br />A thorough summary of the site's history, previous bond release and bond forfeiture actions, <br />settlement agreement, and reclamation history at the mine are accurately captured in the above <br />DRMS Proposed Decision. Public and landowner notifications of the bond release applications <br />were provided to OSM by DRMS. The inspection notifications provided by DRMS, the <br />DRMS's inspection findings for the TOJ, and related correspondence are all documented in the <br />Proposed Decision. OSM, the Bureau of Land Management (BLM), and all affected landowners <br />were notified of the TOJ inspection. <br />The DRMS conducted its TOJ inspection on November 8, 2007. OSM declined to participate in <br />the inspection at that time. OSM participated in the DRMS's June 1, 2009 inspection. This <br />inspection served both as GSM's TOJ inspection and DRMS's final inspection meeting its <br />reduced inspection frequency. <br />The BLM concurred with DRMS' Proposed Decision in a letter dated June 16, 2009 (copy <br />enclosed). DRMS did not receive any objections regarding the TOJ. The Proposed Decision <br />documents the site's compliance with the Colorado approved regulatory program at Rule 3.03.3, <br />and DRMS's bond release guidelines dated April, 18, 1995. The bond release criteria of Rule <br />3.03 have been met to the extent possible given the revoked permit and bond forfeiture status of <br />the site. <br />TAKE PRIDE <br />INAMERICA'''
