NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve with conditions <br />Technical Revision Application No. 72 (TR-72) for the Colowyo Coal Mine (Permit No. C-1981-019), <br />submitted by Colowyo Coal Company L.P.. The Colowyo Coal Company has submitted a Technical <br />Revision for the Colowyo Mine to change their reclamation plan. Colowyo is changing the reclamation <br />plan based on Stipulation 8, which was attached to the permit during the approval of Permit Revision 02, <br />and addresses changes based on knowledge gained over the past 20+ years of mining and reclamation. <br />The revision also includes proposed changes to vegetation success standards. This Technical Revision <br />does change some of the mine's reclamation practices but, at this point, it is unknown whether there will <br />be any changes to the reclamation cost estimate or bond. No new lands are proposed for inclusion in the <br />permit boundary or disturbed boundary. <br />The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south <br />of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit area encompasses approximately 12,250.95 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33•-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
