C-1362 <br />continued public and coal operation access to the Dry Fork of Minnesota <br />creek area: <br />Forest Development Road 711.2 - Dry Fork of Minnesota Creek Road. <br />Forest Development Road 711.2E - Apache Rocks Road. <br />The non-system exploration road which junctions with the Apache Rocks Road <br />and goes in a generally easterly direction to West Flatiron is not open to <br />public, full-size vehicular traffic, but is necessary for continued <br />activities associated with coal mining in the West Flat Iron-area:. <br />All-three of these roads are granted exceptions. <br />Far the.; <br />_purpose of <br />The management of wetlands and floodplains are subject to ExecutivenOrders '-, <br />11990.:,.and 11988, respectively. The purpose of.the Fd's are to avoid=to the <br />;::extent pos.7ible the long and short term adverse impacts associated. with the';•, <br />-destruction or modification of wetlands and floodplains and to avoid-.direct ::=••. <br />or indirect support of new construction in wetlands wherever there is=.a <br />practical;:, al tern ative. <br />A13a., it, in. ro=97%ized that there is a direct relationship hatwean' impacts - <br />on such areas and effects on water quality and aquatic ecosystems::. There <br />is a high risk of irreversible and irretrievable impacts Qn the latter.with <br />operation and developments in wetlands, floodplains and riparian areas. <br />It may become necessary for a waiver, exception or modification (WF.4) to <br />this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the coal reserve. <br />WEM' s to this stipulation will be considered only at the timie operations <br />are, proposed, and will be subject to the Forest Land rind Resource <br />Manacaement Plan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />.Granting of a WEM is a Forest Service discretionary action which:the <br />operator should not routinely expect- The Forest Service reserves the <br />right to impose other stipulations in the same area of this letasehold if a <br />WEM is granted. <br />Conditions under which a WEN may be granted:, <br />If it can be shown through environmental analysis and the application of <br />mitigation measures that the impacts to wetland, tloodplain and riparian <br />resources will be minimized and that no other alternative location for <br />facilities and activities associated with coal mining is practical because <br />of environmental effects and operational considerations (eg,, economics, <br />health and safety, etc.) <br />Any changes to this stipulation will be made in accordance Frith the land use <br />plan and/or the regulatory provisions for such changes. (For guidance on the <br />use of this stipulation, see 8LM Manual 1624 and 3400 or F3 M=Lual 1950 and <br />2820.) <br />Coal-2150-WFR 2/95
