Cattany <br />Division Director <br />Natural Resource Trustee <br />This letter is notification that the Colorado Division of Reclamation, Mining and Safety <br />terminated Stipulation No. 24 for the Bowie No. 2 Mine on June 23, 2009. Stipulation No. 24 <br />had been attached to the approval for Technical Revision No. 45. The stipulation required the <br />submittal of permits from the Colorado Department of Transportation and the US Bureau of <br />Reclamation before an elevated conveyor could be constructed to gob pile no. 3. With the <br />issuance of Technical Revision No. 49 and the approval of a haul road, the elevated conveyor <br />won't be needed so the stipulation was terminated. <br />If you have any questions, please let me know. <br />Sincerely, <br />oseph J.
