23.) Will the side slopes be graded to an approximate 8:1 slope as indicated on the reclamation <br />plan map? <br />24.) Please explain why 7.25 acres was used as a base for this cost estimate, will this be the <br />maximum disturbed acreage at any one time during the life of the mine? <br />Rule 6.4.13 Exhibit M - Other Permits and Licenses: <br />25.) Based off the October, 2008 and April, 2009 Inspection, it would appear that the applicant <br />will need to apply for one of the following permits in order to account for the impounded storm <br />water: <br />1.) Storm Water Discharge Permit: Colorado Department of Public Health and the <br />Environment (CDPHE). <br />2.) Substitute Water Supply Plan: Office of the State Engineer <br />Rule 6.4.19 Exhibit S - Permanent Man-made Structures: <br />26.) At any point during the mining operation, will the affected area be within 200 feet of <br />County Road 74.2. If so, please provide a notarized agreement between the applicant and the <br />person having interest in the road, that the applicant is to provide compensation for any <br />damage to the structure; or where such an agreement cannot be reached, please provide an <br />appropriate engineering evaluation that demonstrates that the road will not be damage by the <br />activities occurring during the mining and reclamation operation. <br />This concludes the Divisions preliminary review of the application. As stated above, the <br />decision date for the application is August 18th, 2009.
