<br />June 9, 2009 <br />Mr. Marv Falconberg <br />Director of City Planning <br />City of Brighton <br />Brighton, Colorado 80601 <br />REW <br />NM <br />CORCREfE YPANY <br />Dear Marv: <br />Please find included in this letter of Public Notification by the State Division of Reclamation, Mining and <br />Safety a notice to amend the current Bromley Lakes Permit M 1987-049. Notification to the City was <br />inadvertently left off the mailing list in April 2009. The original comment period ended May 12, 2009 but <br />because of the oversight the State has agreed to extend your comment period until June 22, 2009. <br />Parts of this amendment to the Bromley permit was requested by the City of Brighton in a signed MOU <br />whereby the City requested a change of use for Cells 2 and 3 to Water Storage as a final end use which <br />we are doing in this amendment change request. <br />Last winter Alan Howard, Bob Fleming, Ron Henley and I met with you and your staff and gave a <br />PowerPoint Presentation of the amendment changes that we have turned into the State and had a question <br />and answer period. I believe the Parks Department was also present at that meeting. <br />In addition Ron Henley and I met with Jim Landeck Public Works Director in January and reviewed the <br />total amendment change with him which also includes adding the Arends, Rheinoehl and Archuleta <br />properties which also includes water storage as a final end use. The City of Brighton has also expressed <br />an interest in these properties as future water storage. <br />I know you are familiar with these changes because of our past communications but I do apologize that <br />you were not sent the proper public notification.
