Box 3471 Rapid City, SD 57,709-3471 (605)348-0244 <br />PO Box 88 Cortez, CO 81321-0088 (970) 564-1380 CELL (605) 390-7255 <br />E-mail: WASTEL[NE6gaol.com or SDLibegygaol.com <br />19 June 2009 <br />See Distribution <br />Subject: Request for agreement on structures on or near the vicinity of the Montoya Pit, M- <br />1980-146, near Durango and Grandview, Colorado <br />Dear Ladies and Gentlemen: <br />Enclosed is an agreement for your signature, which confirms that C & J Gravel Products, <br />Inc. is proposing to continue to operate a sand and gravel pit (the Montoya Pit, sometimes <br />known as the Grandview Pit, on various Gilleland properties and federal land administered by <br />the Bureau of Land Management. That agreement will indemnify you against any damage to <br />structures which may be caused by that operation: that is, this agreement is a specific statement <br />that C&J Gravel Products, Inc. will not damage or destroy, or if they do cause damage, cause <br />your property to be repaired or replaced, in accordance with Colorado state law. In specific, we <br />have identified structures owned and/or operated by you or your company/organization which <br />are likely to be within 200 feet of land affected by mining, and listed in the Distribution List (next <br />page). <br />Please review, and if acceptable, please date and sign and have the agreement <br />notarized and returned to us as soon as possible, by E-mail with hardcopy to PO Box 88, <br />Cortez, 81321. <br />"Affected" can include the construction and use of roadways and trails near the <br />structures, and does not necessarily mean that the area will be mined (materials excavated). <br />We have designed the site, including proposed slopes for both mining and reclamation, as well <br />as roads, to avoid damage to your property, and in accordance with court decisions and county <br />and state requirements. <br />We are required, by Colorado regulations, to request this of you, but you are not <br />required to sign this agreement by Colorado, and your failure to sign will not have, any bearing <br />on the State of Colorado or Archuleta County issuing any permits to C&J to permit mining of <br />sand and gravel. If your structure is actually on the Constant Ranch property, please note that <br />the landowners, Jac and Lee Constant, have a contract with C&J for this project. If your <br />structure is located on adjacent property, please accept this request as an indication that C&J <br />and the Constants intend to continue to be good neighbors. <br />Please contact me with any questions.
