The Colorado Division of Reclamation, Mining and Safety (the Division) is recommending
approval of the application for the Red Mesa Pit, File No. M-2009-023, submitted by Skanska
USA Civil West Rocky Mountain District. This recommendation is based on a finding by the
Division that the Applicant has demonstrated compliance with the requirements of Section 34-
32.5-115(4) of the Colorado Mined Land Reclamation Act for the Extraction of Construction
Materials. Please find enclosed the Division's rationale for the recommendation to approve the
application over the objections to the application filed with this office.
As a reminder to the Division's previous notification to the parties to the application, the Division
has scheduled the application for Formal Public Hearing before the Colorado Mined Land
Reclamation Board for consideration of the application. The hearing has been scheduled for the
August 12 - 13, 2009 Board meeting at 1313 Sherman Street, Room 318, Denver, Colorado,
beginning at 9:00 a.m. or as soon thereafter as the matter can be considered.
Prior to the Formal Board Hearing the Division will schedule a Pre-hearing Conference. The Pre-
hearing Conference will be held to describe the Division's review process, to explain the rights
and responsibilities of parties, to discuss and resolve issues to the extent possible, to describe
the Board Hearing processes, to propose a list of issues under the Board's jurisdiction, to simplify
that list, and to identify parties. All persons who timely objected to the application will receive
notice of the date, time and place of the Pre-hearing Conference.
