Simpson EUIJI IC, GSHAPSON 8 W i= OF COLORADO RECEIVED JUN 19 2009 uivisiui ui meclamation, Mining and Safety The Colorado Division of Reclamation, Mining and Safety proposes to Approve Permit Renewal Application No. 5 (RN-5), submitted by New Elk Coal Company, LLC for a coal mining permit at the Golden Eagle Mine (Permit No. C-1981-013). The proposed renewal will allow for con- tinued final reclamation operations at the site. The Golden Eagle Mine is located in Las Animas County, approximately 20 miles west of Trinidad, -Colorado, Colorado. Coal interest at this un- derground mine is private and the surface to be affected is private land. Due to a final bond release during the previous permit term, the permit area now encompasses approximately 1.20 acres at the reclaimed NW-1 ventilation shaft. This proposed decision is based on a finding that the proposed opera- tion will comply with all requirements of the Colorado Surface Coal Min- ing Reclamation Act, Section 34-33-101 et seq., C.R.S., and the regula- tions promulgated thereunder. A copy of the "Proposed Decision and Findings of Compliance", includ- ing any stipulations, is on file for public inspection at the Colorado Dm"_ sion of Reclamation, Mining and Safety, Room 215 Centennial Building, 1313 Sherman Street, Denver, Colorado 80203, and at the Las Animas County Clerk's Office, 200 East First Street, Room 104, -Trinidad, CO 81082. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
