The Bear No. 3 Mine operation is in compliance with the provisions of this section. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />1. The applicant has demonstrated that sediment ponds and/or treatment facilities will <br />function properly to ensure that disturbed area drainage will meet the effluent <br />limitations of 4.05.2 and the applicable State and Federal water quality requirements <br />for downstream receiving waters. <br />The Division proposes to grant a small area exemption from use of sediment ponds due <br />to the limited size of the area and due to the fact that ponds and treatment facilities are <br />not necessary for the drainage to meet the effluent limitations of Rule 4.05.2 and <br />applicable State and Federal water quality standards for receiving streams, and also <br />due to the fact that no mixing of surface drainage from underground workings will <br />occur. The small area to be exempted is located along the entrance road on the west <br />side of the entry bridge (4.05.2(3)). Technically, a small area exemption is not needed <br />for this area since the subject drainage is from a road. <br />B. Diversions and Conveyance of Overland Flow <br />Disturbed area drainage is controlled and contained by several designed containment <br />ditches. Design details are located in the approved permit application at Section 4.05.3. <br />C. Stream Channel Diversions <br />The Bear Coal Company does not propose permanent or temporary diversion of stream <br />channels. Some flood control work was previously approved and performed along the <br />North Fork of the Gunnison River. Details are provided within the approved permit <br />document at Section 4.05.4. <br />D. Sedimentation Ponds <br />All site sediment ponds are designed and constructed in accordance with Rule 4.05.6. <br />Design details are contained within the approved permit document at Section 4.05.6 and <br />Exhibit 11. <br />Backfilling and grading of the sediment pond at the Bear No. 3 Mine will occur upon <br />successful revegetation of the disturbed area. The hillside spring water treatment pond will <br />be reclaimed when the operator obtains approval from the Colorado Department of Public <br />Health and the Environment to channel the hillside spring water directly to the North Fork <br />of the Gunnison River. The flood control berm will be retained at the Bear No. 3 Mine due <br />to its enhancement of the light residential use land designation of the Bear No. 3 Mine <br />facilities area. <br />E. Acid-forming and Toxic-forming Spoil <br />Acid-forming and/or toxic-forming materials have not been identified at the Bear No. 3 <br />Mine. <br />15
