(Page 2) <br />MINE ID # OR PROSPECTING ID #: N41990_01 F <br />INSPECTION DATE: r.49ing <br />INSPECTOR=S INITIALS: BK <br />OBSERVATIONS <br />The Division conducted a citizens complaint inspection of the site while in the area conducting other inspections. The <br />Division received a call from a citizen in the area stating that the operation has expanded and is removing a lot of rock <br />from areas not covered under the permit. The site is 9.8 acre permit with a total area to be affected not to exceed 9 acres. <br />The operation consists of utilizing a carne and boon. No large mechanized equipment is allowed. The permit area is <br />surrounded on all sides by State of Colorado Land Board. <br />The permit is approved to remove the huge rockslide or talus. The slides range between 9 to 90 feet deep. Most of the <br />removal was to be by hand and a small forklift. Only the top layer of the moss rock COVERED STONE IS TO BE REMOVED. <br />NO BLASTING, CUTTING, EXCAVATION OR CRUSHING IS ALLOWED..NO NEW ROADS ARE TO BE OPENED. <br />The reclamation requirement will be to be minimal, because no top soil will is to be disturbed. Because of the lack of major <br />disturbance,the Board allowed the operator to only post a $2,000.00 warranty. <br />During the inspections, a small quantity of pallets of rock were noted. In addition the boon and carne apparatus with a <br />front end loader was also noted at the time of the inspection. Site was accessed along the Table Mountain quarry side due <br />to operator still not providing the key to the main access blocked by a thick cable. When Mr. Wagner was at the office in <br />late March, he had assured the Division that he was going to provide a duplicate key, which was not available where he <br />said he was going to place the spare key. <br />At the time of the inspection, the operator appears to be in compliance with the approved permit, however, if the operator <br />plans to expand the rock removes to more than what was approved and also increase the current affected and permit area, <br />an amendment to the permit will be required.
