III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the O.C. Mine No. 2 conducted by Marcia Talvitie of the <br /> Colorado DRMS on Thursday, 21-May-2009 beginning at 12:30 p.m. Skies were overcast and <br /> intermittently raining. <br /> Signs and Markers <br /> • A new fence has been installed along the western side of the permit area (Figure 1). The <br /> Castlewood Ranch manager indicated, in a follow-up telephone call, that the fence was <br /> installed last fall. <br /> • The wire on the eastern fence line came off of the metal fence posts during the winter. <br /> Ranch personnel repair all of the fencing each spring prior to bringing cattle in for the <br /> summer. Repairs are scheduled to occur in the first half of June. <br /> • The topsoil stockpile located adjacent to the sedimentation pond is clearly marked with a <br /> sign. <br /> Hydrologic Balance <br /> • The sedimentation pond contained no water, but there was a mud puddle in the bottom. <br /> Fish 8, Wildlife <br /> • Elk tracks were plentiful throughout the permit area. <br /> • Birds sighted in the area included Mountain Bluebirds and robins. <br /> Revegetation <br /> • Overall, the spring growth is ahead of schedule when compared with that observed on the <br /> 19th of May 2008. <br /> • The top surface of the impoundment structure was covered with grasses (Figure 2), as was <br /> the collection ditch upslope from the pond (Figure 3). <br /> • Vegetative cover on the reclaimed slopes in the portal area is less well established (Figure 4), <br /> • The area disturbed by installation of the new fence in the fall of 2008 will be seeded by <br /> Castlewood Ranch this spring. <br /> Reclamation Success <br /> • No noxious weeds were observed during the inspection. <br /> • Overall, slopes appear to be stable with respect to erosion. <br /> • The area appears to be favored by elk, whose presence may be slowing the successful <br /> establishment of vegetation. <br /> O.C.
