III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. <br /> Reclamation <br /> The recently reclaimed pond 4 and pond 5 areas are starting to green up but will take some time to establish a <br /> good vegetative cover.The silt fence was up at the down gradient ends of both areas and no signs of erosional <br /> problems were observed. <br /> The reclaimed main mine site slopes were well vegetated.There were no indications of slope instability or <br /> erosional gullying with the backfilled slopes or terraces. There were a couple of small seep areas on the north <br /> end of the reclaimed mine site but they posed no problem. The upper and lower diversion ditches were well <br /> vegetated.The backfilled highwall remains stable. <br /> The reclaimed coal stockpile area was well vegetated.The upland diversion ditch was also well vegetated and <br /> had sufficient capacity. <br /> There were small seeps coming out of the north and central underdrains. The southern underdrain was dry. <br /> Several sections of black plastic 18 inch diameter culvert were still at the reclaimed coal stockpile area. Survey <br /> stakes and piezometers were still present on the main mine site reclaimed benches. <br /> Noxious Weeds <br /> Some thistle is starting to grow at the base of the lower reclaimed bench at the north end of.'the mine site.The <br /> thistle needs to be sprayed before they become a problem. <br /> Roads <br /> The public road up Hubbard Creek Canyon was dry and in good condition. The mine road across Hubbard <br /> Creek that provides access to the reclaimed main mine site was also dry and in good condition.The light use <br /> road leading to reclaimed pond 5 was dry and passable. The mine site entrance gate was closed and locked. <br /> Signs and Markers <br /> The mine identification sign was on the front gate and contained the required information. Also on the front gate <br /> was the"records location"sign. Surface disturbance markers were up around the disturbed area. <br /> c:/word2007/blueribbon/insp0609 <br />
