Talvitie:'
Thank you for your email correspondence dated June 11, 2009, which follows up on correspondence
from our office in a letter dated May 11, 2009.
It appears that our office had previously concurred on the findings from the investigations you cite in
your correspondence - Cultural Resource Inventory Report for the Block Clearance of the Oxbow
LLC Project (CHS #47148). The report indicates that adequate cultural resource inventory has been
conducted in the area of most of the proposed ventilation boreholes at the Elk Creek and Sanborn
Creek Mine. As our office noted during our review of TR-63, proposed boreholes GVB-LW-15-01
through 15-05 and 16-02 through 16-05 do not appear to fall within the limits of the inventory's
surveyed areas. However, we appreciate the clarification that these proposed sites are located on
steep, brush-covered slopes.
In light of this information, we concur that a finding of no historic properties affected is
appropriate for the proposed activities associated with the subject Technical Revision Application No.
63 (17R-63) Ventilation Boreholes.
Should unidentified archaeological resources be discovered during the course of the project, work must
be interrupted until the resources have been evaluated in terms of the National Register of Historic
Places eligibility criteria (36 CFR 60.4) in consultation with our office.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Shina
duVall, Section 106 Compliance Manager, at (303) 866-4674 or shina.duvall a,chs.state.co.us.
Sincerely,
'6z, /?
