III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was an aerial inspection flown by Harry Ranney of the Colorado Division of Reclamation, Mining <br /> and Safety(Division). Oblique aerial photographs were taken on May 28, 2009 and reviewed in the <br /> office by Jason Musick of the Division on June 15, 2009. Photos taken are provided at the end of the <br /> report. No problems were identified in the photographs. <br /> Roads <br /> The haul road to the refuse area and all access roads and light-use roads identified in the aerial <br /> photographs appeared to be well maintained and stable with no signs of damage and no problems <br /> noted. <br /> Hydrologic Balance <br /> The aerial photographs showed evidence of water in DP-1, PP-2, RP-2/3, RP-4, RP-5, and SS-2. <br /> The pond embankments appeared stable and in compliance with no problems noted. There did not <br /> appear to be any signs of substantial run-off to the ponds or throughout the site displayed in the aerial <br /> photographs with the exception of the northern slopes of Refuse Piles 2/3/4 and 5A. <br /> Processing Waste <br /> Refuse was stockpiled at the southern end of Refuse Pile 5A. Refuse Areas 2/3/4 and 5A appeared to <br /> be well compacted and stable. <br /> Support Facilities <br /> The facilities area at the mine and the area around the buildings appeared to be stable and no <br /> problems were noted. The Slot Storage and the Rail Yard area appeared to be operating as per the <br /> permit requirements. No problems were noted through the aerial photographs. <br /> General Mine Plan Compliance <br /> Return Shaft 3 was in the process of being lined during the aerial inspection of the site. No problems <br /> were noted in the photographs and the site appeared to be functioning as permitted. <br />
