III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Topsoil <br /> • The topsoil stockpile for the Bear Creek Fansite Facility has been laid back against the slope, <br /> and the surface is nicely roughened (Figure 4). It will be seeded and protected with wattles <br /> when the summer help comes on board. <br /> General Mine Plan Compliance <br /> Bear Creek Fansite <br /> • The series of power poles that will carry electrical lines up the valley to the Bear Creek Fansite <br /> Facility had been installed, and the line was in the process of being strung at the time of the <br /> inspection. <br /> • Timber harvesting of those trees cleared to make way for the power line and poles has <br /> begun, but there is still a long way to go. <br /> • At the Bear Creek Fansite Facility, excavation work inside the collar had progressed to nearly <br /> 20 feet below the surface and was nearly complete. Project personnel indicated that the <br /> mini-excavator, powered by a generator on the surface, had proved a useful tool. <br /> • The three utility boreholes permitted under TR-60 and modified by MR-88 were very recently <br /> completed (Figure 5). The cement and water visible on the surface was a result of water in <br /> the borings being pushed to the surface by the grouting operation. The mixture did not <br /> leave the pad area, and was nearly dry at the time of the inspection. <br /> • Concrete footers were in place at the southern end of the Fansite Facility, in preparation for <br /> erection of the substation. A portion of the substation arrived by flatbed trailer during the <br /> inspection (Figure 6). <br /> Methane Ventilation Boreholes <br /> • We drove up the light use road that heads west from Bear Creek approximately one mile <br /> upstream of the Fansite Facility, and looped northward onto Hotchkiss property before <br /> returning to the Bear Creek drainage. <br /> • GVB-LW11-02 is located immediately adjacent to the light use road (Figure 7), and the <br /> associated generator was running on pumped methane at the time of the inspection. <br /> • GVB-LW 11-03, LW 10-05 and LW9-05 were visible across the Bear Creek valley to the east. <br /> Methane pumping at LW09-05 has concluded, but the site has not been reclaimed (Figure <br /> 8); the road will be extended with approval of TR-63. <br /> • Methane pumping has concluded at GVB-LW9-01 B through LW8-02, and these sites are <br /> scheduled for reclamation during 2009 (Figure 9). <br /> • GVB-LW10-01 has been reclaimed already (Figure 10). <br /> This concludes the May 2009 inspection report for the Elk Creek Mine. <br /> Elk Creek Mine C=1981-022 20-May-2009 <br /> -2- <br />
