III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was an Aerial inspection conducted by Janet Binns of CDRMS. Harry Ranney of CDRMS flew over the mine site on <br /> May 28,.2009. Janet Binns reviewed the aerial photographs on June 4, 2009. The mine no longer extracts coal,but the <br /> remaining surface pit(Pit B)is permitted to dispose of flyash. CEC caps, regrades, topsoils,mulches and seeds the pit as the <br /> ash fill progresses. Puddles visible in Pit B and along the haul road indicate that the mine site has received recent <br /> precipitation. <br /> Hydrologic Balance: A small pool of water remains in the lined sewage lagoon. Pond 2 was holding water but showed no <br /> sign of discharge or even water elevation near the discharge elevation. There appears that water is held in the Dugout pond. <br /> Puddles of water are present in the north end of Pit B. <br /> Back611&Regrading- CEC continues to fill Pit B with ash. CEC is beginning to place ash on the upper bench in the <br /> actively working area of pit B. CEC continues to keep up on grading and covering of ash. <br /> Support facilities: No additional construction of third party gas wells or ancillary oil&gas support facilities have been <br /> initiated. <br /> Revegetation* Reclaimed area 31 does not appear to have been seeded to sorghum yet this spring.
