M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator. The sky was very overcast with a little rain falling during the inspection. <br /> Hydrology <br /> There was only a little standing water in the east side sediment pond. The pond embankment was very well <br /> vegetated. Pond inslopes and outslopes were stable. The pond's primary discharge pipe valve was closed. There <br /> was sufficient capacity in the emergency spillway. The west side dugout pond was dry. The open combination <br /> spillway had sufficient capacity. <br /> Collection ditches around the loadout site were functional. Straw bales and silt fence were in place along the <br /> railroad track small area exemption. Some of the straw bales and silt fence were new. <br /> Topsoil Stockpiles <br /> The east topsoil stockpile had a good vegetative cover on it. The collection and diversion ditches protecting the <br /> stockpile were in place. The topsoil signs were up on the stockpile. <br /> The west topsoil stockpile also had a good vegetative cover on it. The protective berm around the stockpile was <br /> in place. Topsoil signs were up on this stockpile as well. <br /> Signs and Markers <br /> Mine identification signs were up at the main entrance,east entrance and along the side road adjacent to the <br /> railroad tracks. <br /> Roads <br /> The paved entrance road was in good condition. There was a little mud that had been tracked onto the highway <br /> from the haul trucks but it was no problem. The east side graveled entrance road was in good condition. The east <br /> side gate was open. The light use dirt road that runs along the railroad tracks was passable. <br /> Facilities <br /> There were no problems observed at the substation,material storage area, loadout office and the coal handling <br /> structures. The crusher/screener was in operation and coal was being loaded into one railcar. There were no <br /> signs of fugitive dust. A front end loader was moving raw coal into the grizzly. This was creating a little <br /> localized dust but it was no problem.A semi was being fueled up at the fuel station and there were no fuel leaks. <br /> Noxious Weeds <br /> The operator sprayed for white top recently. <br /> c:/word2007/terror/insp0609 <br />
