III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the field inspection. The site was dry. There was no activity on site. <br /> Roads <br /> The paved entrance road was in good condition. There were no parked cars blocking access to the site and there <br /> was no debris on the road. The bridge over the river was passable. <br /> Signs and Markers <br /> The mine identification sign at the top of the hill was on the ground and should be put back up. Surface <br /> disturbance markers were up around the disturbed area,except at the base of the cliff,due to possible safety <br /> issues. The"no trespassing"sign was up on the entrance gate. <br /> Hydrology <br /> The collection ditch leading to the sediment pond had sufficient capacity.The river berm that protects the <br /> reclaimed facilities area from high river water was in place. The river was running high but was not close to the <br /> river berm. There were no problems with the two alluvial wells. Well caps were on. The hillside spring was <br /> flowing into the Channel and culvert that lead to the hillside spring water treatment pond. <br /> There was a moderate volume of standing water in the sediment pond. The gated primary discharge pipe and the <br /> emergency spillway were functional.The gated valve was in the closed position. <br /> There was a discharge of about 10 to 15 gpm of water from the hillside spring water treatment pond. The <br /> discharge was the usual orange color,which has been shown in the past to be in compliance with water quality <br /> standards. <br /> Facilities <br /> No new reclamation activity has occurred at the demolished mine office. Building debris has been trucked <br /> offsite.Only concrete sections and the concrete pad remain. The entrance gate to the reclaimed mine site was <br /> open. <br /> Reclamation <br /> The reclaimed portal and fan access road was well vegetated and appeared to be stable. <br /> Weeds <br /> Tamarisk continues to grow in the area of the hillside spring and in the hillside spring water treatment pond. <br /> Tamarisk is also growing at the discharge point of the hillside spring water treatment pond,near the mine site <br /> fence. The operator will deal with the tamarisk soon.The operator also needs to spray the whitetop that is <br /> growing on the reclaimed facilities area. <br /> c:/word2007/bear3/inspO6O9 <br />
