Cattany <br />TO: Eagle Mine C-1981-044 File Division Director <br />Natural Resource Trustee <br />FROM: Jim Stark <br />SUBJECT: RN-05 Moffat County Land Ownership Question <br />DATE: 15 June 2009 <br />On 4 June 2009 the Division sent a letter to Jerry Nettleton of BTUEC regarding a <br />possible coal ownership problem in an area owned by Moffat County in Township 5 <br />North, Range 91 West, Sections 4 and 5. The basic issue was that it did not appear that <br />the legal description shown on page 2.03-17 correlated with the coal ownership shown on <br />Map 2 - Coal Ownership. <br />On 15 June 2009 Jerry Nettleton e-mailed the Division with a response regarding the <br />legal description issue the Division had raised. In the e-mail Mr. Nettleton explained that <br />the legal description for each Section actually contained two separate parcels of land. <br />The areas described as "Lot 4" in Section 4 and "Lot 1" in Section 5 are, in fact, two <br />discrete areas in addition to the two areas described by their section locations. These two <br />lots are each a quarter, quarter section, comprising of 40 acres each. The additional 80 <br />acres total in these two lots makes up the difference that appeared to be missing from the <br />original legal description. <br />Based on the 15 June 2009 e-mail response from Jerry Nettleton, the Division considers <br />the possible coal ownership question raised in the Division's 4 June 2009 letter resolved. <br />cc: Sandy Brown <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
