Based on the RUSLE demonstration, WFC concludes that erosion is less in the post-mine <br />conditions then it was in pre-mine conditions. Irrigated pasture erosion is reduced by 10.8% and <br />dryland pasture erosion is reduced by 42.2%. Observations made during the bond release <br />inspection, as well as observations made during previous inspections, indicate that the irrigated <br />and dryland pasture areas requested for Phase II bond release are stable with good vegetative <br />cover and no significant erosion features. Further, sedimentation ponds are still in place down <br />slope of the areas requested for bond release and these ponds are in compliance with applicable <br />Colorado Discharge Permit System requirements. The Division finds that the method WFC <br />provided for demonstrating that the reclaimed lands are not contributing suspended solids to <br />streamflow or runoff outside the permit area in excess of pre-mining levels are valid. <br />Summary and Conclusions <br />The Division has completed its review and evaluation of the Phase I and Phase II bond release <br />request for the reclamation of the SL-11 application. <br />Based on the observations above, the Division proposes to approve WFC's request for a partial <br />Phase I and Phase II bond release for the New Horizon Mine. This proposed decision will release <br />the applicant from Phase I reclamation liability for Areas 1 and 2 and will release the applicant from <br />Phase II reclamation liability for Areas 1, 2, 3, 4, 5 and 6. <br />13
