SE coal conwow Seneca Coal Com an <br />P Y <br />June 15, 2009 <br />Mr. Daniel Mathews <br />Division of Reclamation, Mining and Safety <br />101 South 3rd, Suite 301 <br />Grand Junction, CO 81501 <br />?V *7 <br />9? <br />RE: Seneca II Mine (Permit C-80-005) <br />Technical Revision No. (TR-48) - Incidental Permit Boundary Revision <br />Mr. Mathews, <br />Seneca Coal Company (SCC) is submitting this technical revision (M-48) to present an incidental permit boundary <br />revision to the existing SCC permit area. This Technical Revision is being submitted concurrent with the permit <br />application for the Sage Creek Coal Company in order to alleviate concerns regarding reclamation liability in the areas <br />removed from the current Seneca II permit. <br />SCC proposes to reduce the area of the original Seneca II permit to accommodate the new Sage Creek Coal Company <br />permit area. The Sage Creek Coal Company permit area will include approximately 3,015 acres of the original Seneca II <br />permit area. The revised Seneca II permit area will retain 382 acres of the original permit area that includes 266.7 <br />disturbed acres. This new Seneca II Mine permit boundary encompasses one isolated watershed and separates runoff <br />Seneca II Mine and the new Sage Creek Coal Company permit area. The isolated watershed discharges to Pond 004, <br />which is an approved NPDES discharge point. The revised Seneca II permit boundary is shown on the attached <br />Exhibit 13-2A, Postmining Topography and Permanent Features Map. SCC does not propose to revise every map in <br />the PAP to reflect the new permit boundary, but rather to insert a sheet in front of appropriate exhibits that directs the <br />reader to Exhibit 13-2A to see the revised permit boundary. <br />There will be an obvious reduction in the amount of reclamation liability for the new Seneca II permit area. In the <br />interim, SCC will continue to hold the full reclamation bond of $6,311,489 on the entire Seneca II permit area until Sage <br />Creek Coal Company receives permit approval and submits a reclamation bond for their new permit area (which <br />includes 3,015 acres of the original Seneca II permit area). Since the Division prepares their own reclamation liability <br />calculation, SCC will review the Division's bond calculation and once agreed upon, will work with the Division to <br />determine the process for release <br />Attached are the required application form, public notice, insertion instructions, and the revised/updated material. <br />Enclosed are two (2) copies of an application for a technical revision to the Seneca II Mine Permit (C-80-005). A third <br />copy has been sent to the Division's Denver Office also addressed to you.
