Rule 3.03.1(3)(c) states that, "Where a silt dam is to be retained as a permanent <br />impoundment... more than sixty percent of the bond may be released only so long as provisions for <br />sound future maintenance by the permittee or the landowner have been made with the Division." <br />Although not specifically addressed in Rule 3.03, the Division evaluates topsoil replacement in <br />conformance with Rule 4.06 and permit requirements, as a component of Phase II bond release. <br />WFC's topsoil redistribution and revegetation plans are found in Volume VI of the permit <br />application, Attachments 2.05.4(2)(d) and 2.05.4(2)(e). Approved topsoil replacement depths vary <br />across the permit area based on the premining soil types, as illustrated on Map 2.05.4-4 of the PAP. <br />The approved revegetation standard at the New Horizon Mine, is a comparison based on results of <br />statistically adequate samples of cover in the reclaimed irrigated pasture compared to the approved <br />technical standard of 71.8%; and a comparison based on results of statistically adequate samples of <br />cover in the dryland pasture compared to statistically adequate samples of cover in the approved <br />Airport Reference Area.
