<br />Peabody <br />PEABODY ENERGY ??E'V?? 701 Market Street <br />St. Louis, MO 63101-1826 <br />314.342.3400 <br /> <br />June 12, 2009 iaivision of Reclamation, <br />Mining and Safety <br />Tom Kaldenbach <br />Division of Reclamation Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />RE: Permit Application Package for Sage Creek Coal Company's Peabody Sage <br />Sage Creek Mine <br />Dear Mr. Kaldenbach: <br />On behalf of Sage Creek Coal Company (SCCC) Peabody Energy hereby <br />transmits three complete sets of the permit application package (PAP) for the proposed <br />Peabody Sage Creek Mine (PSCM). Initial development of the proposed PSCM will <br />consist of facilities construction and continuous miner production of up to 2.0 million <br />tons per year (mtpy) of Wadge coal during the first five-year permit term. The coal is <br />both private and state coal controlled, or soon to be controlled by SCCC. Subsequently, <br />production on the Wadge coal seam will be increased up to about 10.0 mtpy after <br />installation of a longwall system. There is both federal and private coal in the extended <br />mine plan area that must be acquired by SCCC before extraction can occur. Additional <br />copies of the PAP are being distributed concurrently to the applicable federal, state, and <br />county offices. <br />The proposed PSCM permit area includes a large part of Seneca Coal Company's <br />(Seneca's) Seneca II surface coal mine. Seneca is submitting a technical revision for an <br />incidental boundary change to Permit No. C-80-005 concurrent with this submittal to <br />remove the overlapping area from Seneca's permit area, as agreed upon during previous <br />discussions with CDRMS. In addition, the majority of Seneca's reclamation liability will <br />be transferred to SCCC once the SCCC bond calculation is completed. <br />SCCC requests timely review of this PAP with approval by May 1, 2010. The <br />PAP application fee will be provided as soon as possible under separate cover.
