Maintaining the status quo of the contract, however, does not mean. the <br />royalty price in the contract is $1.10 per ton. <br />The Court takes paragraph 6 of the lease at face value. The Count finds <br />Paragraph 6 of the lease allows Plaintiffs to use of 50% of the gravel pit or any <br />newly permitted area exclusively for Plaintiffs` mining activities. Paragraph 6 <br />does not give Plaintiffs exclusive mining rights to the entire gravel pit. <br />Defendants withdrew their claim for injlmctive relief for control of the <br />scale shack fax hearing at a later date. <br />Matter set ,for a. status con#erence on April 1, 2009, at 1:30 p.m for fifteen <br />minutes. At that time, the Court will hear from counsel as to how they would <br />hike the case to proceed.
