-L_ • <br />revision (LOMR) must be submitted to FEMA for review and acceptance. To date, L.G. Everist <br />and the City of Aurora have not submitted a LOMR to Weld County or to FEMA. Therefore, <br />they are riot in compliance with Federal, State, and Local floodplain regulations.. <br />The gravel pit is. also covered under Amended Use by Special Review Permit number <br />AmUSR-1255.. L.G. Everist and the City of Aurora have not yet amended the permit to include <br />the water storage reservoirs that will exist after mining is finished. <br />Weld County is aware that the berms around the Fort Lupton Sand & Gravel site have likely <br />pushed floodwaters off onto adjacent properties. As DRMS is aware, there are Weld County <br />residents who have been complaining that those berms have been causing their properties <br />located east of the site to be flooded more frequently. <br />Weld County objects to the release of the reclamation bond for this area because L.G. Everist <br />has not provided an approved LOMR as required by the federal, state, and local floodplain <br />regulations. They have not amended their FHDP for the reclaimed uses. They have not <br />adequately demonstrated that they are not pushing floodwaters off onto surrounding <br />landowners.
