Cattany <br />Division Director <br />Natural Resource Trustee <br />MV-2009-0 Asphalt Specialties Co., <br />File M-1983-176; Division Approval of <br />On June 12, 2009 the Division of Reclamation, Mining, & Safety (Division) approved the Short <br />Term dewatering plan (Plan) submitted June 10, 2009 by Asphalt Specialties Co., Inc. (Operator) <br />for the Speer Resources Pit in partial compliance with the Finding of Fact, Conclusions of Law and <br />Board Order issued by the State Mined Land Reclamation Board on May 27, 2009. <br />After discussions with the Operator and their consultant, Deere and Ault Consultants, Inc., the <br />Division concurs that installation of either a temporary drain trench or pipe in the southeast corner <br />of the property is acceptable. <br />The Division would like to remind the Operator that the Board Order requires that the installation <br />of the drain must be implemented by June 26, 2009, which is 30 days from the date of the Board <br />Order.
