On May 18, 2009, the Colorado Division of Reclamation, Mining and Safety (the Division) received your
correspondence, dated May 7, 2009, regarding the above referenced permit application. Thank you for
informing the Division of your concerns.
The Division considers your correspondence to be an objection to the application and has scheduled a
Formal Board Hearing before the Colorado Mined Land Reclamation Board for consideration. The
Division previously provided notice of the hearing in a correspondence dated June 4, 2009. We will notice
you and other interested parties of any scheduling change for the Pre-hearing Conference and Board
Hearing. As noted in the Guide to Citizen Participation, provided with the June 4th notice, your party status
in these proceedings is secured through your participation in the Pre-hearing Conference and Board
Hearing.
In an effort to resolve the issues raised by the objecting parties the Division forwarded copies of all
objections and comments to the Applicant (Skanska USA Civil West Rocky Mountain District). Please find
enclosed copy of the Applicant's response to the issues raised by the objecting parties.
Additionally, the Division has enclosed copy of its inspection report generated from May 15, 2009
inspection of the Red Mesa Pit. The Division hopes to resolve all issues raised by the objecting parties
prior to the decision deadline for the application, June 15, 2009.
