Cattany <br />Division Director <br />Natural Resource Trustee <br />On May 18, 2009, the Colorado Division of Reclamation, Mining and Safety (the Division) received your <br />correspondence, dated May 7, 2009, regarding the above referenced permit application. Thank you for <br />informing the Division of your concerns. <br />The Division considers your correspondence to be an objection to the application and has scheduled a <br />Formal Board Hearing before the Colorado Mined Land Reclamation Board for consideration. The <br />Division previously provided notice of the hearing in a correspondence dated June 4, 2009. We will notice <br />you and other interested parties of any scheduling change for the Pre-hearing Conference and Board <br />Hearing. As noted in the Guide to Citizen Participation, provided with the June 4th notice, your party status <br />in these proceedings is secured through your participation in the Pre-hearing Conference and Board <br />Hearing. <br />In an effort to resolve the issues raised by the objecting parties the Division forwarded copies of all <br />objections and comments to the Applicant (Skanska USA Civil West Rocky Mountain District). Please find <br />enclosed copy of the Applicant's response to the issues raised by the objecting parties. <br />Additionally, the Division has enclosed copy of its inspection report generated from May 15, 2009 <br />inspection of the Red Mesa Pit. The Division hopes to resolve all issues raised by the objecting parties <br />prior to the decision deadline for the application, June 15, 2009. <br />Thank you for your participation in these proceedings.
